These Terms of Use ("Terms") govern your access to and use of the Donate ATC website at donateatc.com (the "Site"), operated by Donate ATC LLC ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Donate ATC is a referral and information website. We help users discover and connect with registered 501(c)(3) charitable organizations that support air traffic controllers, pilots, and their families.
We are not a charity. We do not solicit, collect, hold, or transfer donations. When you complete a donation, you are giving directly to the third-party charity through that charity's own donation infrastructure.
We are not affiliated with any of the following organizations: the Federal Aviation Administration (FAA), the National Air Traffic Controllers Association (NATCA), the NATCA Charitable Foundation, the Air Line Pilots Association (ALPA), the Allied Pilots Association (APA), the Southwest Airlines Pilots Association (SWAPA), the Delta Pilots' Charitable Fund, the LeRoy W. Homer Jr. Foundation, the Captain Jason Dahl Scholarship Fund, or any airline. We link to these organizations because we believe they do good work for the aviation community.
Air traffic controllers in the United States are federal employees. Federal ethics regulations (5 C.F.R. § 2635) prohibit them from accepting gifts or gratuities from members of the public in connection with their official duties. Most U.S. airline pilots are similarly restricted by airline policy and FAA guidance from accepting gratuities from passengers.
Nothing on this Site is intended to be, or should be construed as, a tip, gratuity, or personal payment to any controller, pilot, or other aviation employee. All contributions facilitated through the Site are charitable donations made to registered 501(c)(3) tax-exempt organizations. The named honoree of any "in honor of" dedication does not receive any money, gift, or transferable benefit from your donation.
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use this Site. By using the Site, you represent and warrant that you meet this requirement.

When you fill out our donation form, you may submit information including a facility name, an airline, a flight number, a dedication note, your name, and your email address. We use this information to generate a pre-filled dedication text that you may then submit to the third-party charity through their own donation page.
You are solely responsible for the accuracy, legality, and appropriateness of any content you submit. You agree not to submit content that is defamatory, obscene, threatening, infringing on intellectual property rights, or otherwise unlawful. We reserve the right, but are not obligated, to remove any content we believe violates these Terms.
By submitting a dedication, you grant us a non-exclusive, royalty-free license to display, transmit, and process that dedication for the purpose of facilitating your donation.
The Site contains links to third-party websites, including the donation pages of the charities we feature and aviation resources such as LiveATC.net, FlightAware, Flightradar24, the FAA website, AOPA, AirNav, and others. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party site. Your interactions with those sites are governed by their own terms and privacy policies.
The Site may display sponsorship placements or advertising from aviation businesses. Sponsor placements are clearly labeled. The presence of a sponsor on the Site does not constitute an endorsement of that sponsor's products or services, and we are not responsible for any transaction between you and any sponsor.
The Site and all of its content, design, features, functionality, code, layout, graphics, written copy, and underlying technology (collectively, the "Site Content") are owned by Donate ATC LLC or its licensors and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

Restrictions: You agree not to (a) scrape, crawl, or systematically extract data from the Site; (b) reverse engineer, decompile, or attempt to derive the source code of any portion of the Site beyond what is publicly served to your browser; (c) use the Site Content or its underlying concept to build a competing or substantially similar service while using our copyrighted code, design, or trademarks; (d) frame, mirror, or embed the Site on another website without permission; or (e) remove or alter any copyright, trademark, or other proprietary notice.

You agree to indemnify and hold harmless Donate ATC LLC, its affiliates, and their respective officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Broward County, Florida.
